I. INTRODUCTION
This matter is before this court on an appeal from an order for summary judg ment in this diversity of citizenship commercial litigation dispute. The litigation stems from a series of business relationships formed to finance, construct and operate a waste paper recycling facility in Sanford, West Virginia (the “Project”).
