This is an action of the case in assumpsit brought by Luke H. Callan, of Bristol, against the defendant as town treasurer of'thé town of Bristol. The declaration contains a count on book account and certain common counts. No book account was introduced in evidence, but there was introduced in evidence a certain contract made by and between the plaintiff and the town of Bristol, and a notice to the town council relating to the claim that the plaintiff then made.
