The defendant was charged with aggravated assault, battery and criminal damage to property (under $150). After a jury trial at which the defendant represented himself, he was found not guilty on the assault and battery charges, but guilty of criminal damage to property (under $150), although the jury noted on its verdict that: “Due to circumstances the jury unanimously recommends suspension of sentence on the criminal damage charge.” The defendant was nonetheless sentenced to a term of 9 months in the custody of the Department of Corrections; he appeals, attacking the sufficiency of the…
