This is a proceeding in error to the district court of. Johnson county.

Plaintiff in error was convicted by said court of shooting one Thomas B. Parker, with the intent to kill. A jury trial was had which resulted in a verdict of guilty. And after a motion for a new trial had been filed and overruled, defendant was sentenced to imprisonment in the penitentiary.
