This is an appeal from the judgment of the superior court of Seminole county rendered on the 7th day of June, 1943. The motion for new trial was overruled on the 22nd day of June, 1943. The petition in error with case-made attached was filed in this court on the 23rd day of December, 1943. The defendant in error has filed a motion to dismiss the appeal for the reason that this proceeding was not commenced within six months from the rendition of the judgment or order overruling the motion for new trial. 12 O.
