JOURNAL ENTRY AND OPINION

{¶ 1} On August 24, 2005, a Cuyahoga County Grand Jury indicted defendant-appellant Dennis Graves ("Graves") with the following three counts: one count of rape by force or threat of force, in violation of R.C. 2907.02(A)(2); one count of rape by administering a drug or intoxicant to the victim, in violation of R.C. 2907.02(A) (1)(a); and one count of rape while the victim was substantially impaired by reason of mental or physical condition, in violation of R.C. 2907.02(A)(1)(c).
