Summons Case (No. 4, October Term, 1909), to recover damages for the death of plaintiff’s husband. Demurrer to pleas overruled, and at the election of the plaintiff, final judgment entered, and exception noted for her. Writ of error sued out of Supreme Court by plaintiff.

This action Was brought by Sophia L. Perry, the plaintiff, against the Philadelphia, Baltimore and Washington Railroad Company, the defendant, to recover damages for the death and loss of William O.- Perry, husband of the plaintiff, alleged to have been occasioned by the negligence of the defendant company.

The plaintiff’s declaration contained eight counts. The general averments in each were, in effect, that the said deceased, was, on the morning of the twenty-second day of February, A. D. 1909 (in the night time) employed by the Adams’ Express…
