This motion is brought pursuant to section 10 (6) of the Court of Claims Act. The proposed claim, which is attached to the moving papers and which satisfies the requirements of Court of Claims Act § 11, alleges that on three occasions in *301the spring of 1988 the New York State Department of Social Services paia rams of money to 1055 Pharmacy, Inc.
