delivered the opinion of the Court.

This action of ejectment was brought on the demise of the heirs of John Price, to recover six tenements, held *387by as many tenants, within the patent of their ancestor for 500 acres of land, bearing date in July, 1785. This patent is the eldest upon the land in contest except that of S. and E. Hall for 200 acres, which embraces the entire tenement of Evans, one of the defendants, and a part of the tenements of two others, Noe and Tracy.
