Appeal by the plaintiff, the International Money Box Company, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of New York on the 4th day ■ of November, 1903, upon the dismissal of the complaint by direction of the court after a trial at the New York Trial Term.

The action was for goods sold and delivered under a contract between the parties as follows : “ The party of the first part hereby agrees to and does sell unto the party of the second part and the party of the second'part hereby agrees to and does buy of the party of the first part 500 savings boxes patented in the United States of *310America under Letters Patent No. 664990 for the sum of One dollar ($1.00) each net cash, F.
