MEMORANDUM AND ORDER1

BESOSA, District Judge.

Before the Court is defendant Admiral Insurance Company’s (“Admiral”) motion to dismiss the second amended complaint pursuant to Federal Rule of Civil Procedure 12(b)(5) (“Rule 12(b)(5)”) for insufficient service under Federal Rules of Civil Procedure 4(m) (“Rule 4(m)”) and 4(h) (“Rule 4(h)”). (Docket No. 52.) For the reasons discussed below, and after considering the motion to dismiss, plaintiffs reply, and Admiral’s surreply, the Court GRANTS the motion to dismiss pursuant to Rule 4(m) and DISMISSES WITHOUT PREJUDICE the claims against Admiral.…
