[1] After the submission of this case, it was discovered that the clerk’s transcript and statement of facts were missing from the files, having been sent some months previous by the clerk of this court to counsel for appellee, • who had failed to return same. Their attention was called to the matter, and it developed that same had been lost or misplaced by them, and thereupon an opportunity was afforded of substituting the same.
