RAMSEY, Judge.

Appellant was convicted in the District Court of Bowie County on the 16th day of June, of this year, of the offense of murder in the second degree and his punishment assessed at confinement in the penitentiary for a period of five years.

It was admitted that on or about the 3d day of August, 1907, appellant shot and killed one Spencer Lewis. On the trial he interposed a plea of self-defense. The evidence showed that he and Lewis were both negroes, appellant being about sixty years of age and Lewis about fifty years of age, and that they lived in the same neghborhood near the town…
