Action on the case to recover value of horses killed. Appeal from the County Court of Sangamon County; the Hon. George VV. Murray, Judge, presiding. Heard in this court at the November term, 1903.

This suit was brought to recover the value of two horses killed by one of appellant’s trains, near Lanesville, Sangamon county, Iliinois. Hpon the trial the jury returned a verdict for the plaintiff and assessed his damages at $200. Judgment was rendered upon the verdict, from which the defendant appeals.
At the close of the evidence a motion to instruct a verdict for the defendant was overruled by the court.
