This case comes before this .Court from the Circuit Court of the District of Columbia, on a writ of error.

An action was brought in the Circuit Court, by the executors of Lenox against the plaintiffs in error, on .a bond given by them in the penalty of three thousand four hundred dollars; with the condition “that the said John B.
