Martha Poe appeals the District Court’s 1 decisions to affirm an award of costs to defendant in Poe v. John Deere Co., No. 78-0578-CV-W-5 (W.D.Mo. Dec. 14, 1981), and to grant defendant’s motion for summary judgment in Poe v. John Deere Co., No. 81-0365-CV-W-5 (W.D.Mo. Oct. 21, 1981) because the suit was barred by res judicata. She contends that the award of costs was improper because the court did not have the. power to tax costs against the plaintiff, and in the alternative that there was an abuse of discretion.
