Robert Brian Waterhouse, a prisoner under sentence of death, appeals the denial of his successive motion for postconviction relief filed pursuant to Florida Rule of Criminal Procedure 3.851. We have jurisdiction. See art. V, § 3(b)(1), Fla. Const. On January 4, 2012, the Governor signed a death warrant for Waterhouse, with the execution scheduled for February 15, 2012. Waterhouse subsequently sought postconviction relief in the circuit court, presenting two claims.
