This is a direct criminal appeal from embezzlement and conspiracy convictions. John F. Gibson was found guilty by a jury of misappropriating union property in violation of 29 U.S.C. § 501(c). 1 Gibson is the General Secretary-Treasurer of the Hotel and Restaurant Employees’ and Bartenders’ International Union (“The International”). In March, 1979, a Grand Jury sitting in the Southern District of Ohio returned an 18-count indictment against Gibson, alleging numerous acts of embezzlement from the Union.
