This case comes before us on appeals from an order of the Circuit Court of Baltimore County, overruling demurrers to an amended bill of complaint. There is great confusion in the record and it will be well to state with some detail what took place in the lower Court. A bill of complaint was filed March 26th, 1903, by which it was sought to have a decree passed appointing a trustee to sell so much of the estate as was necessary to satisfy a mortgage held by the plaintiff, and for partition of the residue of the property, or, in case a partition could not be made without loss or injury, that…
