Eelators, whose cases were consolidated here, appeal from an order of the district court vacating, dismissing, and quashing writs of certiorari.

On January 4, 1943, respondent, Earle Brown, by election succeeded John P. Wall as sheriff of Hennepin county. Eelators had been employed by Wall as deputy sheriffs a number of years prior to said date. Their original appointments had been made under and pursuant to Minn. St. 1941, § 387.14 (Mason St. 1927, § 917), which provides as follows:

“Every sheriff shall appoint under his hand a sufficient number of persons as deputy…
