Appeal from a judgment of the County Court of Columbia County (Zittell, J.), rendered March 27, 1992, upon a verdict convicting defendant of the crime of criminal possession of a controlled substance in the fifth degree.

Defendant was convicted after a jury trial of the second count of a two-count indictment that charged him with criminal possession of a controlled substance in the third degree and criminal possession of a controlled substance in the fifth degree.
