Tbe judgment appealed from awards a peremptory writ of mandamus to tbe supervisors of tbe town of Hazel Green, in Grant county, commanding them to lay out a highway therein described. On September 1, 1911, the relator, together with more than six other freeholders of tbe town of Hazel Green, made application in writing to tbe supervisors of that town to lay out' the highway in question.
