The issue in this case involves the legality of a>city¿ax, -imposed .upon real estate situated within a district of the-city not ¡laid out into-streets, .and on the slaves employed -thereon. T.he oourt below ,was adverse to the prehensions of the defendants ¿o be exempted from taxation, but considered that ¡the plaintiffs had debarred themselves of the right of collecting the land tax, hind gave judgment for the tax on the slaves only.
