This was an action on a supersedeas bond given by the defendant in error, Oarrie L. *218Emmons, to the plaintiff in error, James M. Gille, to stay execution on a judgment rendered in a mortgage foreclosure proceeding. The controversy between the parties has assumed various phases and has been productive of much litigation in this and other courts.
