Tarsney, J.:

This action was commenced before a justice of the peace, where the plaintiff had judgment for the sum of $58 and costs, from which judgment the defendant appealed to the district court of Lincoln county, where the cause was tried de novo, and judgment was rendered in favor of the plaintiff and against the defendant therein on November 14', 1894, for the sum of $90.62, and costs of suit; and,, thereupon, after the filing and overruling of a motion for a new trial therein, the cause was duly, appealed to this court; and the errors assigned…
