McLennan, J.:
The evidence given on behalf of the People tends to prove that in October, 1889, the defendant married one Sarah V. Hayden in the State of Ohio, and that while she was living, and without *515having obtained a divorce from her, he married one Ida L. Cook in the State of Hew York.
The defendant, who was called as a witness in his own behalf, denied that he married Sarah Y. Hayden in the State of Ohio, as alleged in the indictment, or at any other time or place.
