*854Background

On September 13, 1999, defendant entered guilty pleas to class C felonies in each of the two above-referenced actions in which he had been charged with criminal sale of a controlled substance in the third degree. Pursuant to his plea agreement, defendant was promised, as a second felony offender, concurrent terms of incarceration of three to six years in each case.
