Dissenting. — The following was prepared as the opinion of the court. It did not receive the approval of a majority, and is filed as a dissenting opinion.

The qualified electors of Independent School District No. 1 of Custer County, at an election therefor, authorized a bond issue in the sum of $45,000 for the construction of a schoolhouse. Funds realized from the bond issue, together with other money available for the same purpose, amounted to $47,858.18.
