OPINION
RESTANI, Judge:.Plaintiff-Appellant Kulvir Singh Bara-pind (“Barapind”) appeals the district court’s order dismissing his complaint for lack of subject matter jurisdiction. We hold that the district court did not have jurisdiction over Barapind’s claim because the Defendants-Appellees, the Government of the Republic of India, the State Government of Punjab, and the Punjab Police (collectively, “Indian government”), did not waive their sovereign immunity through their diplomatic communications with the United States. Accordingly, we affirm.
