DAY, District Judge.
In this matter motions were filed to set aside a former order of this court, which order was a summary order setting aside a sale to one Jacob Herskovitz. In the order appointing the receiver in this matter the court granted an injunction restraining all persons from interfering with the property of the bankrupt. Subsequent to this time, Jacob Herskovitz, by his attorney, Benjamin Meek, filed a motion to dismiss the receiver.
