James L. Hite, a resident of Cumberland, brought this suit in the Circuit Court for Allegany County to obtain a divorce a vinculo matrimonii from his wife, Audrey M. Hite, a resident of Martinsburg, West Virginia.

The parties were married in Frederick in June, 1931. For nearly 18 years they lived together in an apartment in Martins-burg. During that time complainant was employed as a conductor on the Baltimore and Ohio Railroad between Brunswick and Cumberland.
