The Mexia independent school district brought this suit against O. P. Arrington, as principal, and the American Indemnity Company, as surety. Arrington was the former tax collector of the district, and the American Indemnity Company was the surety on his bond. The suit was to recover funds alleged to have been misapplied or embezzled by Ar-rington. The trial was before the court and resulted in judgment for the plaintiff against the defendants for the sum of $30,263.62. The American Indemnity Company appealed.
