"We cannot agree with appellee on rehearing that interest before judgment is recoverable on the amount of the damages fixed by the jury. We think the Federal Employers’ Liability Act (45 USCA §§ 51-59) precludes us from so agreeing, assuming that one element of the claim may not sound in damages merely. Such act is paramount and exclusive, and the defendant’s liability cannot be extended by any state statute or rule of construction. St. Louis, S. F. & T. R. Co. v. Seale, 229 U. S. 156, 33 S.
