— The plaintiff in this case filed and served a statement of claim, the substance of which is that the defendant company had entered into a written agreement with the plaintiff, then operating the Pennsylvania Railroad, wherein the defendant, with respect to all cars handled by the plaintiff for the defendant at Douglassville, Pa., agreed that the latter would observe certain terms and conditions of the average basis for settlement for detention of cars and make prompt payment of demurrage charges in accordance therewith; that under this agreement the plaintiff, in February,…
