COLEMAN, Justice.
Plaintiff appeals from judgment for defendant in action for mandamus, temporary restraining order, preliminary injunction, and declaratory judgment.
Plaintiff operates a retail establishment at 123 Avenue K in the City of Lipscomb in Jefferson County where groceries, gasoline, and sundry items are sold. The city clerk testified that plaintiff has a license from the city to operate a “Service station,” and that plaintiff has not applied for a grocery license or a “Mini-Mart” license.
