SHIPMAN, District Judge.

This is a bill in equity to restrain the defendants from the use of a trade-mark for “paints,” which was registered in the patent office on February 21st, 1S71. After full proofs had been taken for final hearing, a motion for a preliminary injunction was heard before Judge Blatcli-ford, whose opinion (Smith v. Reynolds [Case No. 13,098]) recites the allegations of the bill and answer, and the facts which he found to have been proved.
