WYCHE, District Judge.

The plaintiff, Mrs.' Beatrice Malone, the wife of a soldier stationed at Fort Jackson, South Carolina, instituted this action in the United States District Court for the eastern district of South Carolina, to recover damages for personal injuries sustained by her as a result of having been struck, knocked down and run over by a bus of the defendant on Main Street in the City of Columbia, South Carolina, at about 6 o’clock p. m. on the 26th day of January, 1945.
