Lewis, Justice.

The plaintiff, lessee, was awarded a verdict for actual damages against the defendant, as executor of the estate of the lessor, for personal injuries sustained from a fall on the leased premises. The plaintiff’s fall was allegedly caused by a defective condition in the premises created through the negligent repair thereof by the lessor. From the denial by the lower court of timely motions by the defendant for a directed verdict in its favor, for judgment non obstante veredicto and, in the alternative, for a new trial, the dedendant has appealed.
