CHRISTIAN, Judge.

The offense is murder; the punishment, confinement in the penitentiary for ninety-nine years.

The state’s testimony was, in substance, as follows: Appellant and deceased, Dorothy Jones, had been sweethearts. On an occasion shortly prior to the killing appellant and deceased had quarreled, and appellant had struck deceased with his fist. Deceased stated to appellant, in effect, that she would not go with him any more. On another occasion appellant had pasesd the home of deceased and fired a shot from a pistol through the transom.
