JOHNSTONE, Justice.

We granted C.L.C.’s petition for a writ of certiorari to determine whether the Court of Civil Appeals erred in affirming the judgment of the trial court. We reverse and remand with instructions.

On March 19, 2001, C.L.C., a high school student, hereinafter sometimes “the father,” petitioned the Colbert County Circuit Court to adjudicate his paternity of a child and to declare his child legitimate.
