Defendant, convicted of mayhem, appeals from the judgment and from the order denying him a new trial.
1. Complaint was laid before a magistrate jointly charging defendant and others with the offense. The defendant and one Schoedde were together held over for trial. In due time the district attorney filed separate informations against them. This precluded a joint trial, and defendant insists that it was error.
