At issue in the pending motions is not the right of a copyright holder to enforce its copyright, but rather the proper application of the rules governing early ex parte discovery from persons who are not (at least at this time) parties to the pending lawsuit. The issues are of particular importance because Congress has protected, to some extent, the privacy of these third parties.
