Josephine Klein and Bichard Klein, her husband, gave a mortgage on two tracts of land owned by the wife to F. M. Sloan, in the sum of twenty-eight hundred ($2,800) dollars. On December 15, 1926, Samuel T. Marshall, the appellee herein, entered a judgment against Josephine Klein and Bichard Klein, in the sum of twenty-two hundred ($2,200) dollars. Two days thereafter, Bichard Klein and his wife conveyed the mortgaged premises to Wendel J. Kirch and Margaret L. Kirch. This deed was recorded December 23, 1926, and on that date P. M.
