This controversy grows out of the condeinnation of 40 acres of land by the incorporated town of Chelsea for waterworks purposes. The town of Chelsea, on September —, 1910, filed its petition in the district court of Rogers county, praying for the condemnation of the northeast quarter of the southwest quarter of section 23, township 24 north, range 17 east, in Rogers county, Okla. After alleging the necessity for the land, it is further alleged that the title to the land was in dispute. Appraisers were appointed, and they appraised the value of the surface of the land taken at $10 per acre.…
