Appeal from City 'Court of Montgomery, in Equity. Heard, before Hon. A. D. Sayre. The bill wag filed by tlie appellant 'against Rebecca M. Pollard and lier husband, diaries T. Pollard. The prayer of tbe bill was that respondents be required to elect whether they would disaffirm and avoid the purchase by complainant, at its own sale, of the land embraced in a mortgage to it by respondents, and offered, in the event of disaffirmance, to do equity generally and to account for rents.
