KANNE, Circuit Judge.
James D. Hanlon pursued Wisconsin statutory certiorari review in state court of the Town Board of Milton’s denial of his request for a conditional use permit to operate a gravel quarry on his property. Unsuccessful in these state proceedings, Hanlon filed suit in federal district court against the defendants in this case under 42 U.S.C. § 1983. His suit alleged that the Board’s denial of the conditional use permit deprived him of his constitutional rights to due process and equal protection.
