The plaintiff sought to recover damages on account of a personal injury alleged to have resulted from stepping, at nigbt, from a sidewalk into a depression caused by the lowering of the grade of the street by a city a considerable time before the injury, but of which he was not aware. It was alleged, that the difference in level between the sidewalk and the street proper was about eight feet, which was very dangerous, especially in the absence of a light at night; that there had been no light ther'e for more than three weeks; that this had been brought to the attention of the city, which had…
