HAWKINS, Presiding Judge.

Under an indictment charging felony theft appellant was convicted of stealing property under the value of fifty dollars, ánd his punishment was assessed at a fine of twenty-five dollars and thirty days in the county jail.

The property alleged to have been stolen were two auto truck wheels and two auto truck tires mounted on the wheels. They were taken on the night of September 16, 1939, off a truck belonging to Mr. Sitton, which truck was parked for the night at a place not' far from the place of business where the witness Lige Holbrook worked.
