HIGGINS, Justice.

This is a suit by a customer against his stockbrokers, to recover damages said to have been sustained as a result of the alleged illegal and unauthorized sale of plaintiff’s stocks purchased on margin through defendants. The petition alleges that the defendants were employed by the plaintiff under a written contract dated August 22, 1932, as his brokers and agents, to buy and sell stocks for his account on a 30 per cent, margin, the balance of the purchase price being loaned by the defendants to petitioner at the prevailing interest rate and the stock being pledged as…
