In this case an employer, Aerojet-Gen-eral Shipyards, Inc., and its workman’s compensation insurance carrier, The Home Indemnity Company (hereinafter collectively referred to as Aerojet), both appeal the district court’s grant of summary judgment in favor of appellee William M. O’Keeffe, Deputy Commissioner, Sixth Compensation District, United States Department of Labor (O’Keeffe or the Deputy Commissioner hereinafter), entered after all parties moved for summary judgment.
